All Sales Final Policy (Outlet Section)
1. Final Sale
ALL SALES ARE FINAL. No returns, exchanges, or refunds are accepted under any circumstances at the time of purchase except as required by applicable law, including but not limited to the Connecticut Unfair Trade Practices Act (CUTPA) or Connecticut General Statutes § 42a regarding the sale of goods.
2. No Warranties
◦ ALL OUTLET ITEMS ARE SOLD “AS-IS” WITH NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY CONNECTICUT LAW (Conn. Gen. Stat. § 42a-2-316). This disclaimer is intended to be conspicuous. By completing the purchase, the buyer acknowledges and accepts these terms.
3. Conditions of Outlet Items
◦ All outlet items are sold 'as-is' with potential imperfections. These items may include cosmetic flaws, wear, or defects that are not immediately visible or disclosed. Customers purchasing outlet items acknowledge and accept these risks. Customers acknowledge that items purchased sight unseen carry an inherent risk, and The Couch House LLC makes no guarantees about the condition beyond what is disclosed or photographed to the best of our ability. Photos and written descriptions are for general reference only and do not constitute warranties. Customers are strongly encouraged to inspect items in person before purchase.
4. Inspection Responsibility
◦ The customer is solely responsible for thoroughly inspecting the item at the time of delivery or pickup. Any damages, defects, or discrepancies must be noted at the time of delivery or pickup. NO CLAIMS for damage, defects, or discrepancies will be accepted after acceptance unless otherwise required by law. By accepting the item, the customer acknowledges it meets their expectations and waives all claims for defects that could have been discovered through reasonable inspection at the time of acceptance.
◦ If a third party (such as a family member, friend, or other representative) accepts the item on the customer's behalf, their signature is legally binding and considered confirmation that the item has been received in acceptable condition. The Couch House LLC is not responsible for any claims raised after third-party acceptance.
5. Assumption of Risk
◦ The customer assumes all risks regarding the quality, condition, and performance of the item, including any visible flaws or defects after leaving the store or delivery location, and will bear all costs for any servicing or repairs if the item proves defective after purchase.
6. No Refunds for Used or Assembled Items
◦ Refunds will not be issued for items that have been used, assembled, or installed.
Financing Terms and Disputes
1. Financing Approval and Terms
◦ The Couch House LLC offers financing options through third-party companies (e.g., Acima, Snap Financing, Synchrony, Shop Pay/Affirm). By selecting one of these options, the customer agrees to that company’s terms, including payment schedules, interest rates, and any additional fees that may apply. The Couch House LLC acts solely as a facilitator for financing options and assumes no liability for financing terms.
2. Disputes and Questions Regarding Financing
◦ Once the customer signs for financing and the financing company approves the agreement, all disputes, questions, or concerns regarding the financing terms, payments, or account status must be directed to the financing company. The Couch House LLC is not responsible for any issues related to the financing agreement itself, including but not limited to payment schedules, interest charges, or account discrepancies.
3. Financing Payment Responsibility
◦ The customer is solely responsible for making payments directly to the financing company according to the agreed-upon schedule. If a customer fails to make payments or encounters issues with their financing account, they must resolve these issues directly with the financing company, as The Couch House LLC is not involved in the management or resolution of financing disputes.
4. No Refunds or Exchanges for Financed Purchases
◦ All sales made through third-party financing providers are final, and the standard "all sales final" policy applies.Any refund requests must be submitted through the financing company, and The Couch House LLC will not issue direct refunds or exchanges for these purchases.
Pickup & Delivery Policy
1. Scheduling Pickup or Delivery
◦ Pickup or delivery must be scheduled within 48 hours of purchase or by a mutually agreed-upon extended date, subject to approval by management at the time of purchase.
2. Holding Merchandise
◦ The Couch House LLC cannot hold merchandise beyond the scheduled pickup or delivery date. Items not picked up by the scheduled date may be resold, and deposits forfeited.
3. Rescheduling Fee
◦ Rescheduling refers to changes made to the original pickup/delivery date after the purchase has been finalized. Rescheduling within 24 hours of the pickup/delivery date may incur a $50 rescheduling fee.
4. Missed Pickup
◦ If the item is not picked up within 48 hours (or the approved extended date):

Paid in full orders: A 20% restocking fee will apply to missed pickups to cover handling, scheduling, and opportunity cost. This fee is disclosed at the time of purchase.

Hold deposits ($100): Non-refundable.
▪ In the event of a missed pickup, customers may repurchase the item at the current price, subject to availability.
5. Delivery with Wrapped Item
◦ If the customer requests that the couch remain wrapped and not be set up during delivery, this request will also be considered as a final inspection. Once the couch is delivered, wrapped, and not set up, the sale is considered final, and no returns, exchanges, or refunds will be accepted.
6. Delivery Failure Due to Customer Issues
◦ If delivery fails due to incorrect information provided by the customer, such as an incorrect address or inadequate access to the delivery location, The Couch House LLC may charge an additional delivery fee for rescheduling the delivery or for the second attempt.
7. Third-Party Delivery Service Liability
◦ If a customer hires or utilizes a third-party delivery service, The Couch House LLC is not liable for any loss, damage, or defect that occurs during transit and the customer assumes full responsibility for the condition of the item upon receipt. Claims must be filed directly with the delivery provider. Any claims regarding damage or loss should be pursued directly with the third-party service.
If a customer pays The Couch House employees directly or requests off-contract labor, The Couch House LLC and its employees are exempt from all liability for damage, loss, or injury.
8. White Glove Delivery
◦ White Glove delivery includes the delivery of the item to the customer's specified location, fully assembled, and removal of packaging materials. Any additional services, such as moving other furniture or removal of old furniture, will incur extra charges.
9. Delivery Outside Standard Area
◦ For deliveries outside the standard service area or to locations requiring special access (e.g., narrow doorways, apartments without elevators), additional delivery charges may apply. The Couch House LLC will inform the customer of any additional fees before finalizing the delivery schedule.
Pickup Policy
1. Vehicle Size
◦ Customers must ensure their vehicle is appropriately sized to safely transport purchased items. The Couch House LLC is not liable for damage caused by customer negligence, including the use of an improperly sized vehicle.
2. Wrapping and Securing Materials
◦ The Couch House LLC does not provide wrapping materials, tie-downs, or other securing equipment. Customers are responsible for bringing the necessary supplies to safely secure their items for transport.
3. Assistance with Loading
◦ Our associates may assist with loading, but we reserve the right to refuse assistance if there is a risk of injury or property damage. Assistance will be provided using only the materials and equipment supplied by the customer. However, it is solely the customer's responsibility to properly secure the item(s) before leaving the premises.
4. Damage During Loading or Transportation
◦ The Couch House LLC is not responsible for any damage to merchandise, vehicles, or property during loading or transportation. The Couch House LLC is not responsible for damages caused by third-party delivery services or services provided by employees beyond the scope of their duties, unless such damages arise from gross negligence or willful misconduct. This includes but is not limited to damage resulting from improperly secured items, accidents during transport, or any other incidents after the items leave our premises.
Delivery Return & Cancellation Policy
1. Restocking Fee for Returns or Cancellations
◦ If a customer chooses delivery and decides to return or cancel the item upon arrival for any reason other than damage caused by The Couch House delivery team (e.g., customer change of mind, fitting issues, or undisclosed defects), a $100 restocking fee will be deducted from the deposit or full purchase amount.
2. Outlet Items Purchased Sight Unseen
◦ Customers who purchase outlet items sight unseen and request delivery, accept all risks regarding the item's condition. Customers purchasing without inspection waive all claims for visible defects. In-person inspection is strongly recommended for 100% satisfaction before purchasing.
3. Free Delivery Promotions
◦ If a customer takes advantage of a free delivery promotion but then cancels or rejects the delivery, the $100 restocking fee will still apply and be deducted from the couch price.
Delivery Labor Policy
1. Agreed Labor Terms
◦ Our delivery team will provide only the services specified in the original sale agreement.
2. Upgrading Delivery Service
◦ If a customer initially selects curbside delivery but later requests inside delivery and setup, the service will be upgraded to our White Glove Delivery, and the additional cost must be paid in full prior to scheduling or performing the upgraded service.
3. Additional Labor Requests
◦ If a customer requests additional labor (e.g., moving other furniture, removing an old couch, or taking an item to the dump), an extra charge will apply on the spot for these services.
4. Direct Payment to Employees
◦ If a customer pays The Couch House employees directly for extra labor, or if an employee decides to provide additional labor without compensation to The Couch House, The Couch House LLC and its employees are exempt from all liability for any damages or issues that may occur. Customers assumes full liability.
Sectional: Outlet Liquidation Inventory Clarification
All of our couches are sold "as-is." This means that while we offer significant discounts, our couches may have varying conditions based on the following classifications.
The Couch House LLC operates as an outlet liquidation store, and all items are sourced directly from reputable, big-name brand stores. We do not sell personal, second-hand couches. We do not personally collect or resell used couches from individual homes.
The couches in our inventory include:
• New Items: Brand new, never used, and factory-sealed.
• Floor Models: Display models that have been used in showrooms for customer viewing.
• Customer Returns: Couches returned by customers in new or gently used condition.
• Overstock: Excess inventory from major retailers that has not been sold.
• Past Season Models: Furniture from previous seasons, often discontinued or replaced by newer models.
When a couch is classified as as pre-owned, this refers to items that may show more significant signs of wear and tear than new or floor models. However, these couches do not have a documented history of ownership, and we do not resell couches from private individuals or homes. We make every effort to disclose any visible imperfections or damages to the best of our knowledge. Customers are encouraged to inspect all items thoroughly before purchase, as we cannot guarantee perfection in appearance or condition.
The Couch House LLC is certified by the Department of Consumer Protection for sterilization and holds a permit as a secondhand dealer of upholstered furniture. This certification ensures that all of our upholstered furniture has been properly sanitized and meets the necessary safety standards for resale.
Shipping Outside of Connecticut (Online Purchases)
The Couch House LLC only offers delivery within Connecticut and the surrounding local areas. We do not offer shipping outside of Connecticut. If an online order is placed for delivery beyond our service area, it will be canceled and refunded minus any applicable credit card or processing fees as stated on our website.
When checking out online, customers will only be presented with the pick-up option at checkout. Shipping outside of Connecticut is unavailable, and refunds for such requests will be subject to the above-mentioned deductions.
Policy Modifications
• The Couch House LLC reserves the right to modify its policies at any time, but any changes will only apply prospectively.The most current version will be available on our website or in-store.
